Terms and Conditions of Service
Please read these Terms and Conditions carefully before placing an order. By submitting your website URL and completing payment, you confirm that you have read, understood, and agreed to be bound by these Terms in full.
1. Definitions
In these Terms, the following words have the meanings set out below:
- “MySiteCheck”, “we”, “us”, or “our” means the website audit services offered by MySiteCheck, carried on as a sole proprietorship in British Columbia, Canada, under the name MySiteCheck.ca.
- “Client”, “you”, or “your” means any individual or business that places an order through mysitecheck.ca or communicates directly with MySiteCheck to purchase a service.
- “Service” means any website audit, analysis report, or competitor comparison report purchased from MySiteCheck.
- “Report” means the PDF document and any accompanying files (such as CSV exports) delivered to you as the output of a Service.
- “Target Website” means the website URL you provide to us when placing an order.
- “Competitor URL” means any third-party website URL you specify for inclusion in a competitor comparison analysis.
- “Order” means a completed purchase of a Service through our payment system.
2. Acceptance of Terms
By submitting your website URL, completing payment, or otherwise engaging MySiteCheck for a Service, you confirm that:
- You have read and agree to these Terms and Conditions in full.
- You are at least 18 years of age or have the legal authority to enter into a binding agreement on behalf of a business entity.
- You have the legal right and authority to request an analysis of the Target Website you provide.
- All information you provide to us, including website URLs, is accurate and complete to the best of your knowledge.
- If you are ordering on behalf of a business, you have the authority to bind that business to these Terms.
3. Client Ownership, Authority, and Legal Responsibility
3.1 Warranty of Website Ownership or Authority
By providing a Target Website URL and placing an Order, you represent and warrant to MySiteCheck that:
- You are the registered owner, operator, or an authorised representative of the Target Website; or
- You have explicit written authorisation from the owner or operator of the Target Website to commission an audit of that website on their behalf.
MySiteCheck does not independently verify ownership of any website. The sole responsibility for ensuring you have the right to request an analysis of any website rests entirely with you.
3.2 Client Indemnification
You agree to indemnify, defend, and hold harmless MySiteCheck and its operators from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Any false or misleading representation that you own or have authority over the Target Website;
- Any third-party claim that you did not have the right to commission an analysis of the Target Website;
- Any use you make of the Report that violates applicable law or the rights of any third party;
- Any inaccurate, incomplete, or misleading information you provide to MySiteCheck.
3.3 Fraudulent Orders
MySiteCheck reserves the right to refuse, cancel, or withhold delivery of any Report if we reasonably believe that you do not own or have authority over the Target Website, or that the Order was placed fraudulently or in bad faith. In such cases, no refund will be issued and we reserve the right to report the matter to relevant authorities.
4. Scope of Service and What Is Included
4.1 Homepage-Centric Analysis
The majority of our automated analysis — including performance testing, AI-assisted content review, search engine optimisation signals, technology stack detection, and SSL certificate checks — is conducted on the homepage of your Target Website. This is intentional. The homepage is the primary entry point for most visitors and the most commercially significant page of any website. Automated tools analyse the homepage as the representative page of the site.
You acknowledge and accept that our automated analysis is primarily homepage-focused and does not constitute a full audit of every page on your website.
4.2 Manual Page Review (Where Included)
Where a Service includes a manual page-by-page review conducted by our team, the following conditions apply:
- Manual review covers up to the number of pages specified in your Order (typically up to 4 pages total, including the homepage).
- Any pages submitted for manual review must be subpages of the same root domain as the Target Website. For example, if your Target Website is example.com, only pages such as example.com/about, example.com/services, and example.com/contact qualify for manual review.
- Pages on separate domains, subdomains (unless the subdomains form the primary website), or third-party platforms that are not part of the Target Website domain will not be reviewed, even if you provide those URLs.
- MySiteCheck reserves the right to disregard any submitted URL that does not meet the above criteria without notice, refund, or replacement.
- If no additional pages are specified, manual review will focus on the homepage only.
4.3 Site Crawl Analysis (Where Included)
Where a Service includes a full-site crawl, the crawl is conducted on publicly accessible pages of the Target Website only. The crawl identifies technical issues such as broken links, missing metadata, duplicate content, and redirect errors across multiple pages. The crawl does not access password-protected pages, staging environments, or pages explicitly blocked by robots.txt.
4.4 What Is Not Included
Unless explicitly stated in the Service description at the time of purchase, the following are not included:
- Implementation of any fixes, recommendations, or changes to your website;
- Ongoing monitoring or recurring analysis;
- Consultation calls, screen-sharing sessions, or advisory meetings;
- Search engine ranking guarantees or performance improvement commitments;
- Analysis of any pages outside the Target Website domain;
- Access to your website's backend, content management system, hosting account, or analytics platform (unless you voluntarily provide access).
5. Competitor Comparison Analysis
5.1 Scope of Competitor Analysis
Where you purchase a Competitor Comparison Service, you may provide up to two Competitor URLs for analysis. The competitor analysis is strictly limited to publicly accessible, automated checks on the homepage of each Competitor URL provided. Specifically, competitor analysis includes:
- Performance laboratory scores (the same scores a browser developer tool or Google's public performance tools would produce);
- SSL certificate status and expiry date;
- Platform and technology stack fingerprinting based on publicly visible HTML and response headers;
- AI-assisted review of publicly visible homepage content.
5.2 What Competitor Analysis Does Not Include
Competitor analysis is not a full-site crawl of any third-party website. It does not include:
- Crawling, indexing, or analysis of any page other than the publicly accessible homepage of the Competitor URL;
- Any access to backend systems, internal data, or non-public information belonging to any competitor;
- Any activity that could be construed as hacking, scraping beyond normal browser activity, or unauthorised access to any system.
You acknowledge that competitor analysis produces a snapshot of publicly observable data at the time of the audit and that this data may change at any time. MySiteCheck makes no representations about the accuracy or completeness of competitor data.
5.3 Client Responsibility for Competitor URLs
You are solely responsible for providing competitor URLs that are appropriate, legal, and relevant to your business. By providing a Competitor URL, you confirm that:
- You have a legitimate business reason for requesting analysis of that URL;
- You are not using the competitor analysis for any purpose that violates applicable law, including but not limited to unfair competition, defamation, or any form of unlawful competitive intelligence gathering;
- You understand that the analysis is based on publicly available data only.
6. Accuracy and Limitations of Analysis
6.1 No Guarantee of Accuracy
All analysis conducted by MySiteCheck relies on automated tools, third-party data sources, and AI-generated content interpretation. While we make reasonable efforts to produce accurate and useful Reports, we cannot guarantee the accuracy, completeness, or fitness for any particular purpose of any analysis. Results are based on publicly available data at the time the audit is conducted and may not reflect changes made to any website after that point.
6.2 AI-Generated Content
Reports may include sections generated or assisted by artificial intelligence. AI-generated content is reviewed as part of our process, but may contain errors, omissions, or interpretations that do not perfectly reflect the state of your website. You should apply your own judgment and, where appropriate, seek professional advice before acting on any AI-generated findings.
6.3 Lab Scores vs. Real-World Performance
Performance scores included in Reports are laboratory scores produced under simulated conditions. These scores may differ from the real-world experience of your website visitors depending on their devices, locations, internet connections, and other factors outside our control. Lab scores are useful directional indicators but are not a guarantee of actual visitor experience.
6.4 Point-in-Time Snapshot
All analysis represents a snapshot of your website and any Competitor URLs at the specific time the audit is conducted. Websites change frequently. MySiteCheck is not responsible for any changes that occur before or after the audit date, and the Report does not reflect any changes made after the audit was completed.
7. Payment and Refunds
7.1 Payment
All Services must be paid for in full before delivery. Payment is processed by Stripe. By completing payment, you agree to Stripe's terms of service in addition to these Terms. MySiteCheck does not store your payment card details.
7.2 Refund Policy
Due to the nature of our Services, which involve significant time and resource investment upon Order placement, the following refund policy applies:
- Refunds are available if you request cancellation before we have begun work on your Report. To request cancellation, contact [email protected] as soon as possible after placing your Order.
- Once work on your Report has begun, no refund will be issued, regardless of whether the Report has been delivered.
- If MySiteCheck is unable to complete a Report due to technical issues on our end, we will either re-attempt the audit or issue a full refund at our discretion.
- Dissatisfaction with the findings of a Report, including findings that are less severe than expected, does not constitute grounds for a refund.
7.3 Disputed Charges
If you believe a charge was made in error, contact us at [email protected] before initiating a chargeback with your payment provider. Chargebacks initiated without prior contact with MySiteCheck may result in cancellation of any pending Orders and may be contested.
8. Delivery
Reports are delivered by email to the address you provide at the time of Order, typically within 48 business hours of payment confirmation. Delivery times are estimates only and are not guaranteed. Business hours are Monday through Saturday, 9:00 AM to 9:00 PM Pacific Time.
MySiteCheck is not responsible for delivery failures caused by incorrect email addresses, spam filters, or issues with your email provider. If you have not received your Report within 72 hours of payment, contact us at [email protected].
9. Confidentiality and Use of Reports
9.1 Client Use
Reports are prepared exclusively for the client named in the Order. You may use your Report for internal business purposes, share it with your web developer, designer, marketing agency, or other professional advisors, or use it to inform decisions about your website.
9.2 Restrictions on Use
You may not:
- Resell, sublicense, or distribute any Report to any third party for commercial gain;
- Publish or publicly display any Report, or substantial portions of any Report, without our prior written consent;
- Use any Report to make false, misleading, or defamatory claims about any competitor or third party;
- Represent any Report as having been produced by any party other than MySiteCheck.
9.3 MySiteCheck Confidentiality
We will not share the content of your Report, your website URL, or any other information you provide with any third party, except as required by applicable law or to deliver the Service (for example, using third-party tools and APIs as part of our analysis process). We do not sell client data.
10. Intellectual Property
The format, structure, layout, and methodology of MySiteCheck Reports are the intellectual property of MySiteCheck. Upon full payment, you are granted a non-exclusive, non-transferable licence to use the Report for the purposes described in Section 9.1.
Content generated about your specific website, including findings, scores, and recommendations, is provided to you for your use. The underlying tools, templates, scoring frameworks, and methodologies remain the property of MySiteCheck.
11. Limitation of Liability
11.1 No Consequential Damages
To the fullest extent permitted by applicable law, MySiteCheck shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of profits, loss of business, loss of data, or loss of customers, arising out of or in connection with any Service, Report, or these Terms, even if we have been advised of the possibility of such damages.
11.2 Cap on Liability
To the fullest extent permitted by applicable law, MySiteCheck's total aggregate liability to you for any and all claims arising out of or in connection with any Service shall not exceed the total amount paid by you for the specific Service giving rise to the claim.
11.3 No Liability for Implementation
MySiteCheck provides analysis and recommendations only. We are not responsible for any outcomes arising from actions you take or do not take based on your Report. Implementation of any recommendations is entirely at your own risk and discretion.
12. Disclaimer of Warranties
Services and Reports are provided on an “as is” and “as available” basis without any warranty of any kind, express or implied. To the fullest extent permitted by applicable law, MySiteCheck disclaims all warranties including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
MySiteCheck does not warrant that any Report will improve your website's performance, search engine rankings, conversion rates, or any other business outcome. Any improvements are solely the result of changes you choose to implement based on the Report.
13. Privacy
MySiteCheck collects and processes only the information necessary to deliver our Services, including your name, email address, website URL, and payment confirmation. We do not sell, rent, or trade personal information to third parties. Our data practices comply with applicable Canadian privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA).

14. Acceptable Use
You agree not to use our Services for any purpose that is unlawful or prohibited by these Terms. Without limiting the foregoing, you agree not to:
- Submit URLs of websites you do not own or have authority over;
- Use our Services to gather intelligence about competitors for any illegal purpose;
- Attempt to reverse-engineer, copy, or reproduce MySiteCheck's methodologies, tools, templates, or Report formats;
- Circumvent, disable, or interfere with any security or access controls on any website, including competitor websites, in connection with our Services;
- Use our Services in connection with any illegal activity, including fraud, identity theft, or intellectual property infringement;
- Engage in any conduct that could damage the reputation or operations of MySiteCheck.
15. Changes to These Terms
MySiteCheck reserves the right to update or modify these Terms at any time. Updated Terms will be posted at mysitecheck.ca/terms with a revised effective date. Continued use of our Services after an update constitutes acceptance of the revised Terms. For Orders already in progress at the time of a change, the Terms in effect at the time of Order placement will apply.
16. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms or any Service shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.

17. General Provisions
Entire Agreement: These Terms, together with any Order confirmation, constitute the entire agreement between you and MySiteCheck with respect to the subject matter hereof and supersede all prior agreements.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Failure by MySiteCheck to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.
Assignment: You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely.
Force Majeure: MySiteCheck is not liable for any delay or failure to deliver Services caused by circumstances beyond our reasonable control.
